TERMS OF SERVICE

These Terms of Service ("Terms") apply to in-studio services, memberships, retail purchases, and other offerings provided by Keohane Ventures LLC (o/a Pvolve San Diego, Pvolve La Jolla & Pvolve Del Mar) ("we," "us," or "our"). We operate independently under a franchise agreement with Pvolve Development, LLC and are solely responsible for services provided at our California-based studio locations.

By attending a class, purchasing a product, or interacting with us in any way at our studio locations, you agree to be bound by these Terms. If you do not agree to these Terms, do not attend classes, make purchases, or use our services.

1. Studio Services

We provide in-person fitness classes, private sessions, workshops, and merchandise for purchase. All purchases made at our studio locations are subject to these Terms.

2. Eligibility and Studio Access

By engaging with our Services, you represent that you are at least 18 years old or the legal age of majority in California. If you are under 18, you may only use our Services with the consent of a parent or legal guardian.

3. Health Disclaimer

Our Services include physical fitness programs. You should consult your physician or other health care provider before beginning any exercise program. Participation is at your own risk. You acknowledge that physical exercise involves inherent risks and assume full responsibility for your participation.

4. Purchases and Payments

All purchases (including memberships, drop-ins, and retail products) made in studio are final unless otherwise stated. We accept credit/debit cards, and other approved payment methods. We reserve the right to change our pricing at any time.

5. Cancellations and No-Show Policy

We enforce a cancellation policy for group and private classes. Late cancellations or no-shows may result in forfeiture of class credits or incurring a fee, as detailed in studio signage or client materials. Please check with the front desk or your membership agreement for the most current policy.

6. Membership Terms

Memberships may be offered on a monthly or other recurring basis. By purchasing a membership, you agree to the recurring charges unless cancelled per the studio’s cancellation procedures. Terms of use, freezes, and cancellation policies are made available at the time of purchase or upon request.

7. Returns and Refunds

Retail purchases made in studio may be eligible for return or exchange if unworn/unused and in original condition, within a specified time frame (e.g., 14 days). Memberships and class packages are non-refundable unless otherwise required by California law.

8. Personal Conduct and Safety

We reserve the right to deny access or remove individuals from our studio for behavior that is disruptive, unsafe, or in violation of these Terms or our Code of Conduct. All members and guests are expected to treat staff and other clients with respect.

9. Waiver and Release of Liability

By participating in our Services, you agree to release and hold harmless Keohane Ventures LLC, its owners, employees, and affiliates from any and all claims, liabilities, or damages that may arise from your participation in any activity, except where prohibited by law.

10. Intellectual Property

All logos, branding, and materials provided in studio are the intellectual property of Pvolve Development, LLC and/or Keohane Ventures LLC. You may not record, copy, or distribute any of our materials without written permission.

11. Privacy

Your information is handled according to our Privacy Policy, available at our studio and online. By using our Services, you consent to the collection and use of your information as outlined in our policy.

12. Arbitration Agreement

In accordance with California law and our franchise agreement, any disputes arising from your use of our Services will be resolved by binding arbitration in San Diego County, California. By using our Services, you waive your right to bring claims in court or as part of a class action.

13. California Consumer Rights

14. Pvolve San Diego SMS Program

By opting into the Pvolve San Diego SMS Program, you agree to receive text messages from Keohane Ventures LLC (o/a Pvolve San Diego, Pvolve La Jolla & Pvolve Del Mar). These messages may include updates about your class schedule, booking confirmations, special promotions, studio news, and important service-related notifications.

You can cancel the SMS service at any time. Simply text "STOP" to the shortcode. Upon sending "STOP," we will confirm your unsubscribe status via SMS. Following this confirmation, you will no longer receive SMS messages from us. To rejoin, sign up as you did initially, and we will resume sending SMS messages to you.

If you experience issues with the messaging program, reply with the keyword HELP for more assistance, or reach out directly to [email protected].

Carriers are not liable for delayed or undelivered messages.

As always, message and data rates may apply for messages sent to you from us and to us from you. Message frequency varies. For questions about your text or data plan, please contact your wireless provider.

15. Changes to These Terms

We reserve the right to update or change these Terms at any time. Updates will be posted at the studio and on our website. Your continued use of our Services after such changes constitutes your acceptance of the updated Terms.
